Section 2: Auction Terms & Conditions
The following terms apply to all auctions conducted by Bussey Bros Auctioneers, whether conducted on-site, online, or through any other bidding method.
By registering, bidding, or participating in an auction, you agree to these terms.
1. Registration & Bidder Approval
All bidders must register and be approved prior to participating in any auction. Registration may require providing:
- Full name
- Address
- Phone number
- Email address
- Valid payment information
- Business details (if applicable)
We reserve the right to approve or deny any bidder at our discretion.
2. Buyer’s Premium
A buyer’s premium may be applied to all purchases. The specific rate and any applicable caps will be disclosed in the individual auction listing or terms.
3. Payment Terms
- All purchases must be paid in full within the time frame specified for each auction.
- No items will be released until payment is received and cleared.
- Accepted payment methods may include cash, check, wire transfer, or credit card (fees may apply).
- Sales tax may be applied unless a valid exemption is provided.
4. Removal & Storage
- Buyers are responsible for removing purchased items within the stated removal period.
- Items not removed within the allotted time may be subject to storage fees or forfeiture.
- Any damage or loss during removal is the responsibility of the buyer.
5. Condition of Items (“As-Is, Where-Is”)
All items are sold “as is, where is”, with no warranties or guarantees of any kind, expressed or implied.
Descriptions, photographs, and information are provided as a courtesy and are not guaranteed. Buyers are encouraged to inspect items prior to bidding.
6. Inspection
Preview or inspection opportunities may be provided prior to the auction. It is the bidder’s responsibility to inspect items and determine condition, authenticity, and suitability.
7. Risk of Loss
All risk of loss or damage transfers to the buyer immediately upon purchase. Buyers assume full responsibility for items once the auctioneer declares them sold.
8. Default & Non-Payment
If a buyer fails to make payment within the specified time:
- The auctioneer may cancel the sale
- Retain any deposits or payments as liquidated damages
- Resell the item
- Hold the buyer responsible for any deficiency, fees, or costs
9. Indemnification
Buyers agree to indemnify and hold harmless Bussey Bros Auctioneers, the seller, and associated parties from any claims, damages, or liabilities arising from the purchase, ownership, removal, or use of any item.
10. Safety & Compliance
Buyers are responsible for ensuring that all purchased items comply with applicable safety standards, including OSHA and other regulatory requirements, before use.
11. Auctioneer Authority
The auctioneer reserves the right to:
- Accept or reject bids
- Withdraw or add items
- Group or divide lots
- Resolve bidding disputes at their sole discretion
All decisions by the auctioneer are final.
12. Disputes
In the event of a dispute between bidders, the auctioneer’s decision shall be final and binding.
13. Independent Contractor
Bussey Bros Auctioneers acts as an agent for the seller and is not responsible for the acts or omissions of the seller.
14. Additional Terms
Specific auctions may include additional terms and conditions. Any such terms announced or published for a particular auction will take precedence over these general terms.
