These Bidder Terms and Conditions (“Terms”) apply to auctions conducted by Bussey Bros Auctioneers and constitute a legal, valid, binding, and enforceable contract between Auctioneer and the Bidder. These Terms also form the basis for the final contract of sale between the Seller and the Buyer. By participating in the Auction, whether at the auction site, online, telephonically, or through any other means (including Absentee Bid), Bidder agrees to be bound by, and to abide by, these Terms and Conditions.
Buyers Premium & Removal Dates
A 10% Buyers Premium will be charged to all bidders/buyers. Buyers Premium is capped at $5,000 per item for onsite bidders.
All items must be removed from premises within 30 business days. Any item still on premises after 30 business days will be charged a $20 per item, per day fee.
There is a no return policy at all of our auctions. Buyer, do your own inspections! Everything sells "as is, where is." No warranties or guarantees! Call to preview your item or come look at the equipment on the following preview dates: April 1-2, 2021, 9AM – 6PM.
Identification: All participants are required to register prior to becoming an Approved Bidder. All participants must provide full name, permanent street address, phone number(s), email address, valid credit card information, and business name.
Deposits: International buyers may be asked to submit a refundable deposit.
Payment: Invoices must be paid in full after the auction unless otherwise specified. No merchandise will be released until the invoice is paid in full. Applicable sales tax will be applied to all sales unless the buyer has proper exemption.
Manner of Payment: Invoices will be emailed within 24 hours of the close of the auction. Payment can be made at removal by cash or company check. Wire transfer information is located on your invoice. Payments using American Express, Discover, MasterCard, or Visa are made through our office for an additional 4%. Full purchase price on all lots sold to the same buyer must be paid within the specified time and prior to the removal of any goods. Online bidders have 3 business days after the auction to make settlement.
Removal: All purchases must be removed during the announced or publicized removal period. A fee of $20 per day will apply for purchases not removed within 30 days.
Condition of Articles Sold: Neither the auctioneer nor the seller is responsible for the correct description, genuineness, authenticity, or defect in any lot. Information is provided from sources deemed reliable, but Bussey Bros Auctioneers makes no warranty or guarantee as to the accuracy of the information. No sale shall be set aside nor allowance made for any incorrectness, error in cataloging, or any imperfection not noted. Descriptions and photos are not guaranteed. Items are sold "as is" and without recourse.
Safety Devices: Articles purchased may not incorporate approved activating mechanisms, operating safety devices, or safety guards, as required by OSHA or otherwise. It is the purchaser’s responsibility to ensure articles purchased are equipped and safeguarded to meet OSHA and other requirements before use.
Indemnification: Purchaser shall defend, indemnify, and hold auctioneer and seller harmless from all claims and liabilities related to the condition, removal, or use of the articles purchased, or failure to comply with federal, state, and local laws, including OSHA and Environmental Protection Agency requirements.
Claims: No claims will be allowed after removal of goods from premises or for items left on premises past the allowed time limit.
Responsibility for Non-Delivery: Neither the auctioneer nor the seller is liable for non-delivery or any other matter to any purchaser of any lot, other than for the return of the deposit or sum paid on said lot.
Compliance with Terms of Sale: In default of payment within the specified time, the auctioneer may retain all monies received as liquidated damages. Lots not paid for and removed within the allowed time may be resold at public or private sale without further notice, and any deficiency, along with all expenses and charges of resale, including legal fees, will be charged to the defaulting purchaser.
Risk to Person and Property: Persons attending during exhibition, sale, or removal of goods assume all risks of damage or loss to person and property and specifically release the auctioneer and seller from liability. Neither the auctioneer nor the seller is liable for any defect in or condition of the premises where the sale is held.
Contract Movers: If a purchaser hires a machinery mover or other contractor, they must provide proper insurance protecting Bussey Bros Auctioneers and the sale's property owner against claims arising from personal injury or property damage caused by their actions.
Addition to or Withdrawal from Sale: The auctioneer reserves the right to withdraw property from sale, add property to the sale, group lots, or subdivide lots as deemed necessary.
Dispute Between Bidders: The auctioneer’s decision is final and absolute.
Records: The auctioneer’s record of sale is final in the event of any dispute.
Independent Contractor: The auctioneer is acting as an independent contractor only and is not responsible for the acts of its principals or sellers.
Additional Terms and Conditions: The auctioneer may add additional terms and conditions of sale, announced prior to the auction.
Reserve: The auctioneer reserves the right to reject any and all bids. For lots with a reserve, the auctioneer or his agents may bid on behalf of the seller.
Item Removal: All items must be removed from the auction site within 30 business days of April 3, 2021. Items not removed will be forfeited or charged $20 per day, per item fee.
